Minimum Energy Efficiency Standard (MEES)

The Minimum Energy Efficiency Standard (MEES) aims to improve the energy efficiency of the national building stock and support the transition towards more sustainable, efficient buildings. Through an energy efficiency audit, landlords, property owners and asset managers can better understand building performance, identify improvement opportunities and prepare for evolving minimum energy performance requirements.

From April 2018, it became unlawful to grant new leases for non-domestic properties in England and Wales which do not meet the standard. The minimum standard is currently an EPC rating of E, this will move to a B rating by 2031 for buildings over 1,000m². Buildings below 1,000m² will continue to be subject to the current minimum standard of EPC E.

These regulations extended to all privately rented properties from April 2023. Domestic rental properties must achieve a C rating by 2030.

Our comprehensive service helps organisations improve energy efficiency, remain compliant and avoid substantial financial penalties. Fines for non-compliance are linked to the rateable value of the property and can reach as much as £150,000.

As a trusted sustainability consultancy, we help clients look beyond immediate compliance requirements and build a longer-term strategy for improving building performance and reducing energy consumption.

What exemptions apply to MEES?

If a property falls within the scope of MEES, it may still be possible to continue letting the property where a valid exemption applies. These exemptions must be entered on the PRS Exemption Register and generally remain valid for five years.

An exemption may apply where a required third-party consent for energy improvement works has been refused despite reasonable efforts to obtain it. This may include planning permission, listed building consent or consent from a superior landlord.

Where the expected payback period for energy efficiency improvements exceeds seven years, the property may qualify for an exemption. Evidence must be available to support this position.

An exemption may apply where an independent surveyor confirms that implementing the required energy efficiency improvements would reduce the market value of the property, or the wider building, by more than 5%.

Where an individual or organisation becomes a landlord unexpectedly, a temporary six-month exemption may be available. This recognises that immediate compliance may not always be practical in exceptional circumstances.

Planning ahead for MEES and EPC compliance

Where a valid exemption applies, a non-domestic property with an EPC rating below E may still be let. However, exemptions must be registered and renewed correctly, making accurate EPC advice essential for managing compliance risk.
